Terms and Conditions

1. Acceptance of Terms

By creating an account or using the ClassResponse (CRS) platform, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must not use the platform. These terms apply to all users including Teachers and Super Administrators.

2. Platform Purpose

CRS is a feedback collection and analytics platform designed for educational institutions. Teachers use the platform to create feedback sessions, collect anonymous student responses, and analyse results. Users agree to:

• Use the platform solely for legitimate educational feedback purposes
• Provide accurate information during registration and profile setup
• Respect the anonymity of student response submissions
• Not attempt to identify individual anonymous respondents

3. User Responsibilities

Teachers

• Create and manage feedback sessions professionally and ethically
• Distribute session access codes only to intended students
• Use collected feedback data constructively for teaching improvement
• Keep account credentials confidential and secure

Super Administrators

• Maintain data confidentiality and exercise administrative privileges ethically
• Manage subscription plans and system settings responsibly
• Protect user credentials and system security

4. Subscription Plans and Payments

CRS offers Free, Premium, and Custom subscription plans. Payments are processed via SSLCommerz in accordance with Bangladesh Bank regulations. By subscribing to a paid plan you agree to:

• Pay the applicable fees at the time of subscription
• Abide by the usage limits of your chosen plan
• Contact support for billing disputes within 30 days of the charge

CRS reserves the right to modify plan pricing with reasonable advance notice. Continued use after a price change constitutes acceptance of the new pricing.

5. AI Analytics — Google Gemini

• Your session analytics data will be sent to Google’s Gemini API for AI processing
• Google’s own Gemini API Terms of Service and Privacy Policy apply to that processing
• CRS is not responsible or liable for how Google processes, stores, or uses data submitted to the Gemini API
• You assume full responsibility for ensuring that the data you submit through AI features is appropriate and compliant with your institutional policies
• Do not submit personally identifiable student information through AI features — CRS only sends aggregated, anonymised statistical data

CRS makes no representation regarding the accuracy, completeness, or fitness for purpose of any AI-generated insights. AI outputs are provided for informational purposes only and do not constitute professional advice.

6. Prohibited Activities

Users must not:

• Attempt to breach platform security or access unauthorised areas
• Submit false, misleading, or malicious feedback or data
• Share account credentials with unauthorised individuals
• Reverse-engineer, scrape, or automate requests to the platform without written consent
• Use the platform for any activity that violates Bangladeshi law or applicable international law
• Upload or transmit malicious code, spam, or any harmful content
• Attempt to identify anonymous student respondents

7. Intellectual Property

All platform software, design, trademarks, and content are the intellectual property of ClassResponse (CRS). Users retain ownership of data they create (courses, sessions, CLO sets) but grant CRS a limited, non-exclusive licence to store and process that data to provide the service.

8. Limitation of Liability

To the maximum extent permitted by Bangladeshi law, CRS shall not be liable for:

• Any indirect, incidental, or consequential damages arising from platform use
• Loss of data due to user error, hardware failure, or force majeure events
• Actions, outputs, or decisions made by third-party AI services (including Google Gemini)
• Temporary service interruptions due to maintenance, updates, or technical issues

9. Account Termination

CRS reserves the right to suspend or permanently terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the platform. Users may request account deletion by contacting support; data deletion will follow the retention schedule described in the Privacy Policy.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the People’s Republic of Bangladesh. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Bangladesh. CRS complies with the Digital Security Act, 2018 and other applicable Bangladeshi legislation.

11. Changes to These Terms

CRS may update these Terms periodically. Material changes will be communicated via email or an in-platform notice. Continued use of the platform after the effective date of any change constitutes your acceptance of the revised Terms.
